The US EPA’s formal notification that greenhouse gases endanger public health will take effect next month. The first proposed rule related to the finding is expected by March and would set standards for tailpipe emissions of greenhouse gases. Such standards, which are expected to be challenged in court, would also result in the requirement that stationary sources install Best Available Control Technology (BACT). It is not clear how BACT will be defined. The EPA is also expected to specify new source performance standards (NSPS) for industrial emissions. The EPA is expected to issue NSPS and greenhouse gas limits for the cement plants by June. Proposed limits on carbon dioxide are expected to be announced at the same time.
