Hitachi Sued Over Mass Spec

BYU and Torion charge that the infringement was willful and that Hitachi contributed to it. The plaintiffs seek compensatory damages as well as royalties. Neither company issued a statement.

Salt Lake City, Utah 12/8/08—Brigham Young University (BYU) and MS company Torion Technologies have filed suit against Hitachi High-Technologies America in the US District Court for the District of Utah, alleging infringement of US Patent No. 7,060,987, entitled “Electron Ionization Source for Orthogonal Acceleration Time-of-flight Mass Spectrometry.” BYU granted Torion an exclusive license to the technology in March. The suit claims that the radio-frequency electron capture dissociation component of Hitachi’s NanoFrontier eLD LCMS infringes at least four claims of the patent.
