Affymetrix Files Suit Against Pacific Biosciences
Affymetrix is requesting the court award it compensatory, consequential, exemplary and punitive damages, as well as a permanent injunction against Pacific Biosciences‘ solicitation of Affymetrix employees and its use of Affymetrix’s confidential information.
San Jose, CA 11/3/10—In a complaint filed in California Superior Court in Santa Clara County, Affymetrix has charged Pacific Biosciences and 15 former employees with tortious interference with contract, intentional interference with prospective economic advantage, breach of fiduciary duty, breach of duty of loyalty, conspiracy and breach of contract. Affymetrix alleges that since August 2009 Pacific Biosciences has induced at least 15 of its employees to leave Affymetrix and work for Pacific Biosciences. The complaint also alleges that these employees breached their confidentiality agreement with Affymetrix and disclosed confidential information to Pacific Biosciences, which was used to gain an unfair competitive advantage. Affymetrix seeks damages and an injunction.
