Bruker Wins Patent Battle in Japan
The equivalent US patent (US Patent No. 6,141,100) is entitled “ Imaging ATR Spectrometer”. A Bruker spokesperson told IBO that Bruker Optics filed an invalidation suit in Japan in October 2007. The positive ruling was received in June 2008 and finalized this April. An ATR accessory is used for the analysis of solid and liquid samples without sample preparation.
Billerica, MA 8/20/09—Bruker has announced that the Japan Patent Office has invalidated Digilab’s (Varian’s) Japanese Patent Number 3 076 013 on a Focal Plan Array-based imaging Attenuated Total Reflection (ATR) system. As a result, Bruker Optics Japan and other manufacturers can now sell imaging FT-IR spectrometers and FT-IR microscope systems with ATR imaging capabilities in Japan, according to Bruker.
