Court Dismisses Illumina Suit Against Affymetrix
In her decision, Judge Barbara R. Crabb wrote, “the accused products do not include a ‘substrate,’ as required by each of the asserted claims.” Illumina has filed an appeal in the case.
Madison, WI 12/14/10; Santa Clara, CA 12/15/10—Affymetrix announced that the US District Court for the Western District of Wisconsin has granted the Company’s motion for summary judgment that it does not infringe two Illumina patents: US Patent Nos. 7,510,841 (Methods of Making and Using Composite Arrays for the Detection of a Plurality of Target Analytes) (see IBO 5/15/09) and 7,612,020 (Composite Arrays Utilizing Microspheres with a Hybridization Chamber). As a result, the court has directed that the patent infringement suit be dismissed. Illumina issued no statement.
