Court Dismisses MS Suit

Hitachi High-Technologies stated that it had been fully vindicated and had not provided any compensation to the plaintiffs. Frank Compagni, a lawyer for Bringham Young University, told Bloomberg that the plaintiffs had decided to “walk away” from the dispute.

Pleasanton, CA 8/24/09—Hitachi High-Technologies America announced that on August 6 the US District Court for the District of Utah, Central Division, dismissed a patent infringement lawsuit brought against the company by Brigham Young University and Torion Technologies (see IBO 12/15/08). The suit alleged infringement of US Patent No. 7,060,987 (“Electron Ionization Source for Orthogonal Acceleration Time of flight Mass Spectrometry”) related to the radio-frequency electron capture dissociation component of Hitachi High-Technologies America’s NanoFrontier eLD LCMS. Hitachi and Torion stipulated on August 4 that the claims were to be dismissed. Torion issued no statement.
