New Suit for Sequenom
Mr. Hawran’s initial suit named Sequenom Board members Harry F. Hixson Jr., PhD, Richard Lerner, MD, and Ronald Lindsay, PhD, as defendants. Dr. Hixson is the company’s current chairman and CEO and Dr. Lindsay serves as executive vice president, R&D.
Washington, DC 9/21/10; Washington, DC 9/29/10—In a filing with the SEC, Sequenom disclosed that former CFO Paul Hawran has amended a lawsuit to add the company as a defendant. The amended suit adds claims of breach of conduct and negligent misrepresentation. In August, Mr. Hawran filed suit in the Superior Court of California for the North County of San Diego against the three company directors who served on a special committee investigating the company’s conduct in relation to the development of its prenatal diagnostic test for Down syndrome. Mr. Hawran and other executives resigned following the committee’s findings (see IBO 9/30/09). In the original suit, Mr. Hawran alleged defamation, invasion of privacy, negligent or intentional interference with prospective economic advantage, and unfair business practices. He also alleged that he was asked to resign because he raised concerns about certain directors’ conduct.
