QIAGEN and Applied Biosystems Settle Thermal Cycler Litigation
The companies’ quick resolution of the matter provides greater assurance for end-users. Given the timing, the agreement may also have been facilitated by Corbett’s acquisition by QIAGEN.
Venlo, The Netherlands 1/22/09—Corbett, QIAGEN, ITF Labortechnik and Applied Biosystems have settled their disputes concerning the infringement by Corbett’s Rotor-Gene Real-Time PCR-Cyclers of Applied Biosystems’ Real-Time Thermal Cycler Instrument patents. Corbett, which was acquired by QIAGEN last year (see IBO 7/15/08), has entered into an agreement to license certain technology from Applied Biosystems related to its Real-Time PCR-Instrumentation and its use, covering all fields. Applied Biosystems had filed suit against Corbett in Germany, and Corbett filed a declaratory judgment suit against Applied Biosystems in the US (see IBO 7/15/08). Corbett and ITF Labortechnik had also filed an intervention in opposition proceedings before the European Patent Office.
