SilcoTek Files Patent Infringement Lawsuit Against Waters Corporation

BELLEFONTE, PA. — SilcoTek, the world’s leading provider of high-performance coatings applied by chemical vapor deposition, well-known for serving the Semiconductor, Analytical Instrumentation, Life Science, and Energy sectors, announced today that it has filed a Complaint in the U.S. District Court of Delaware alleging patent infringement against Waters Corporation.

SilcoTek is a small business located in Bellefonte, Pennsylvania, but SilcoTek serves the most innovative companies throughout the world in a variety of collaborative efforts. Waters Corporation, located in Milford, Massachusetts, is a massive player in the High-Performance Liquid Chromatography (HPLC) Industry, and employs more than 8,200 people worldwide and operates in over 35 countries, including 14 manufacturing facilities, and has products available in more than 10 countries.

The Complaint identifies two SilcoTek patents, U.S. Patent No. 10,881,986, entitled, “Liquid Chromatography Technique” and U.S. Patent No. 11,131,020, entitled, “Liquid Chromatography System and Component”. The Asserted Patents generally relate to HPLC, and the coating services that SilcoTek performs on HPLC components, including without limitation, chromatography columns. The Waters’ products at issue include, without limitation, “Atlantis Premier,” “ACQUITY Premier,” “XBridge Premier,” “XSelect Premier,” “CORTECS Premier,” and “MaxPeak Premier SEC” chromatography columns, and “ACQUITY Premier” and “Arc Premier” chromatography systems.

SilcoTek invests heavily in its intellectual property to support an innovative culture, which includes an “In the Light” core value, thereby fostering collaboration as explained in SilcoTek’s core values described at www.SilcoTek.com/mission. SilcoTek respects the intellectual property rights of others, and expects that its intellectual property rights will likewise be respected by everyone from the largest of companies to individuals. SilcoTek has full confidence in the strength of its patent position and plans to vigorously enforce its intellectual property, and protect itself from infringement.

SilcoTek is fortunate to be supported by Omni Bridgeway, a global legal finance and risk management company, to help handle the substantial size disparity of this case. SilcoTek is represented in this matter by Cecilia Dickson, Kent Baldauf Jr., and Barry Coyne of The Webb Law Firm.

The case is SilcoTek Corporation v. Waters Corporation, (D. Del. 2023).
