France

France’s Ministry for Ecology, Sustainable Development, Transportation and Housing has issued a decree requiring the manufacture, importation or distribution of nanomaterials equal to or over 100 grams be reported. The decree also applies to “professional users” and labs that use nanomaterials in those amounts. Reports must be submitted to the French National Agency for Food Safety, Environment and Labor by May 1, 2013. The definition of a nanoparticle is the same as that used in REACH regulation and includes fullerenes, graphene flakes and single wall carbon nanotubes with an external dimension of less than one nanometer, as well as nanomaterials in a mixture that are released during use. This regulation is the first of its kind in Europe.
